The air you breathe, the water you drink, the food on your plate – all of these depend on a functioning environment. And yet, environmental degradation is accelerating worldwide, directly threatening the fundamental rights that every human being is entitled to. The connection between environmental protection and human rights is no longer a philosophical debate; it is a legal, ethical, and deeply practical reality that shapes the lives of billions. Understanding this connection is essential for anyone interested in psychology, policy, or simply the future of life on Earth.

Human rights and the environment are deeply intertwined. As the UN Environment Programme (UNEP) puts it, human rights cannot be fully enjoyed without a safe, clean, and healthy environment – and sustainable environmental governance cannot exist without the establishment of and respect for human rights. This is a two-way relationship: environmental harm erodes human rights, and the denial of rights (such as the right to information or participation) weakens environmental protection.

In July 2022, the UN General Assembly adopted a landmark resolution declaring that every person on the planet has a right to a clean, healthy, and sustainable environment. The resolution was passed with 161 votes in favour and zero against, with only eight abstentions. While not legally binding, this resolution was a watershed moment – it formally recognised what more than 100 national constitutions around the world had already enshrined: that environmental quality is a human right.

Environmental rights can be divided into two broad categories. Substantive rights are those where the environment directly affects whether you can enjoy the right at all – including the right to life, the right to health, the right to food, and the right to an adequate standard of living. Procedural rights are the tools used to protect those substantive rights – specifically, access to environmental information, public participation in decision-making, and access to justice.

How environmental degradation threatens human rights

Environmental degradation – through climate change, pollution, deforestation, and the over-exploitation of natural resources – is not an abstract issue. It has tangible, measurable impacts on people’s rights.

Climate change and the right to life

Climate change is one of the most severe threats to human rights today. According to Amnesty International, the World Health Organization estimates that climate change will cause approximately 250,000 additional deaths per year between 2030 and 2050 due to malnutrition, malaria, diarrhoea, and heat stress. Extreme weather events – floods, heatwaves, wildfires, and storms – are already killing and displacing people at an alarming rate.

As UN News reported, Professor Joyeeta Gupta of the Earth Commission argues that even one degree Celsius of warming violates the rights of over 100 million people globally. The world crossed that threshold in 2017 and is projected to breach 1.5ยฐC by 2030. The consequences include melting glaciers, collapsing ecosystems, and irreversible damage that no amount of future cooling can undo.

Natural resource exploitation and livelihoods

The reckless extraction of natural resources – fossil fuels, minerals, timber – destroys ecosystems that communities depend on for survival. Human Rights Watch has documented how inadequate regulation of industries like mining, agriculture, and fossil fuels drives human rights violations worldwide. The primary victims are often impoverished and marginalised communities who have the least power to influence decisions and the fewest resources to cope with the damage. In the Brazilian Amazon, for example, illegal cattle ranching and land-grabbing have displaced indigenous communities and destroyed their livelihoods, while environmental defenders who resist face threats, violence, and even murder.

Pollution and health

Air pollution, largely caused by burning fossil fuels and industrial processes, is directly linked to over 1.2 million premature deaths annually. Water pollution from agricultural runoff, untreated sewage, and industrial waste compromises the right to safe drinking water for hundreds of millions of people. These are not side effects – they are direct violations of the right to health and the right to life, especially for children, the elderly, and people in low-income communities.

Displacement and food insecurity

The World Meteorological Organization (WMO) has highlighted that at the end of 2023, nearly three in four forcibly displaced people were living in countries with high-to-extreme exposure to climate-related hazards. Global acute food insecurity has more than doubled in recent years, from 149 million people before the COVID-19 pandemic to 333 million in 2023. Climate change worsens this by disrupting food production, reducing water availability, and increasing the frequency and severity of droughts and floods.

Public participation and the right to information

One of the most powerful tools for protecting environmental rights is ensuring that ordinary people can participate in the decisions that affect their environment. This idea is at the heart of the Aarhus Convention, a ground-breaking international agreement adopted in 1998 by the UN Economic Commission for Europe (UNECE).

The Aarhus Convention rests on three pillars: the right to access environmental information held by public authorities, the right to participate in environmental decision-making, and the right to seek justice when these rights are denied. It is the only legally binding global instrument on environmental democracy, and it explicitly links environmental rights to human rights.

The Convention operates on a straightforward premise: when people know what is happening to their environment and have a say in how decisions are made, environmental outcomes improve. Governments become more accountable, and the risk of harmful projects being approved without scrutiny decreases. As the UNECE noted on the 25th anniversary of the Convention, public involvement in decision-making underpins the universal right to a clean, healthy, and sustainable environment – and is more important now than ever.

However, challenges remain. Public participation is the most common area where compliance issues arise – accounting for 43% of all non-compliance cases brought to the Aarhus Convention Compliance Committee. Access to justice comes next at 37%, followed by access to information at 14%. The costs of participation, the lack of technical expertise available to ordinary citizens, and power imbalances between communities and well-resourced developers all limit the effectiveness of public involvement.

Sustainable development: balancing rights and resources

Sustainable development is the principle that economic growth and resource use should meet the needs of the present without compromising the ability of future generations to meet their own needs. It is, in essence, an ethical commitment – and it is closely tied to environmental human rights.

The UN Development Programme (UNDP) has emphasised that the 2022 UN General Assembly resolution recognises how climate change, unsustainable management of natural resources, pollution, and biodiversity loss all interfere with the full enjoyment of human rights. This resolution is expected to empower citizens to hold governments accountable and catalyse concrete action.

Sustainable development requires that environmental considerations are integrated into every aspect of economic planning – from energy production and agriculture to urban development and trade. Countries are increasingly embedding human rights language in their climate commitments. Through initiatives like the Nationally Determined Contributions (NDCs) under the Paris Agreement, governments set emission reduction targets, and a growing number are doing so with explicit attention to human rights, gender equality, and the inclusion of indigenous peoples and young people.

But sustainable development also demands accountability from the private sector. The Geneva Environment Network notes that businesses must respect both the environment and environmental rights, ensuring that their operations do not violate these standards. The UN Guiding Principles on Business and Human Rights provide the global framework for this, but implementation remains uneven.

Ethical considerations in environmental protection

The ethics of environmental protection are not only about policy – they are about fairness, responsibility, and justice across generations and geographies.

Intergenerational equity

One of the most pressing ethical questions is what we owe to future generations. The Aarhus Convention explicitly acknowledges an obligation to future generations. The UN Committee on the Rights of the Child has recognised that children – both those living today and those yet to be born – have a fundamental right to a clean, healthy, and sustainable environment. Over 16,000 children were consulted in the drafting of this guidance, which places clear obligations on governments and businesses alike.

Climate justice and inequality

The impacts of climate change are profoundly unequal. Low-income countries and vulnerable communities – who have contributed the least to greenhouse gas emissions – bear the greatest burden. Globally, the richest 10% of households are responsible for 34-45% of total household emissions, while the poorest 50% contribute only 13-15%. This imbalance turns a climate crisis into a justice crisis. High-income countries have both a historical responsibility and a moral obligation to reduce emissions more aggressively and to provide financial and technical support to those who are most affected.

Environmental defenders

Across the world, people who stand up for environmental rights face enormous personal risk. Human Rights Watch reports that activists and ordinary citizens defending their land and environmental rights face intimidation, legal harassment, and deadly violence. Between 2012 and 2023, more than 2,100 land and environmental defenders were killed globally. Protecting these individuals is both an ethical imperative and a practical necessity – without them, environmental governance becomes weaker and less accountable.

Human rights as a framework for resolving environmental conflicts

Environmental conflicts – disputes over land use, resource extraction, pollution, and development projects – are some of the most challenging issues facing communities and governments today. A human rights-based approach offers a powerful framework for resolving these conflicts.

This approach shifts the focus from purely economic or technical considerations to the rights and well-being of the people affected. It demands that decision-makers consider who will be harmed, who will benefit, and whether the most vulnerable populations have had a meaningful voice in the process. It also provides legal tools: individuals and communities can take governments and companies to court for failing to protect environmental rights.

Climate litigation is a growing field. In 2019, the Netherlands’ highest court ordered the Dutch government to cut carbon emissions faster, ruling that climate change posed a direct threat to human rights. Brazil’s supreme court declared the Paris Agreement a human rights treaty, arguing that it should take precedence over national law. In 2024, the European Court of Human Rights found violations of the European Convention in a case about inadequate climate measures. These legal developments signal a shift: environmental protection is increasingly enforceable through human rights law.

The Office of the UN High Commissioner for Human Rights (OHCHR) has been at the forefront of promoting a rights-based approach to climate action. Its work includes advocacy, research, and on-the-ground programmes supporting environmental human rights defenders, as well as pushing for the inclusion of human rights standards in climate policies and agreements.

The road ahead

The recognition of environmental rights as human rights is a significant step forward, but recognition alone is not enough. Implementation remains the key challenge. Laws must be enforced, communities must be given real power to participate, and both governments and businesses must be held accountable for the environmental damage they cause or allow.

Psychology plays a role here too. How people perceive environmental risk, how communities mobilise for collective action, and how individuals cope with the psychological impacts of environmental degradation – these are all areas where environmental psychology intersects with human rights. Understanding these dynamics is essential for designing policies that are not only fair but also effective in changing behaviour and protecting well-being.

The triple planetary crisis of climate change, biodiversity loss, and pollution is not slowing down. Addressing it requires a framework that places human dignity at the centre – and that is exactly what a human rights-based approach to the environment provides.
